
It is possible to appeal a decision of the Committee. There is a 28 day time limit for appeals (to High Court) starting with date on which notification of decision was served. If you are unsure of your position, we can review your matter and advise you on your prospects of success on appeal together with any other relevant factors such as cost liabilities.
The Committees decision will not take effect until either the appeal period expires or the appeal is determined. However, the Committee can impose an immediate order for suspension or conditions if it feels that this is in the best interests of the public and/or the doctor.
No application may be made for restoration to the HPC register after a strike off, before 5 years have expired from the date of that erasure. Any application will be heard by a Committee in an oral hearing. If you do intend to apply for restoration, we can advise you on how to proceed and what the Committee will need to be satisfied of. It is important to ensure that any application is properly prepared as only one application may be made within any 12 month period.
